Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CallCapture application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Media Dot Ltd. ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

CallCapture is a call recording and voice memo service that provides the following functionality:

  • Call recording — record incoming and outgoing phone calls using Twilio service numbers via a three-way conference merge. You initiate a recording by calling or being connected to a designated service number during your phone call.
  • Voice memo recording — record audio voice memos directly within the App for personal reference
  • AI-powered transcription — automatic speech-to-text transcription of your recordings with speaker identification
  • AI-powered enrichment — AI-generated summaries, entity extraction, commitment and action item detection, topic identification, and sentiment analysis of your recordings
  • Semantic search — search across your recordings by meaning, not just keywords, using vector embedding technology
  • Cloud storage — secure storage of your recordings and associated data in the cloud, accessible from your device

The Service may be modified, updated, suspended, or discontinued at any time. We do not guarantee that any particular feature will remain available. If we discontinue the Service entirely, we will provide reasonable advance notice and, where practicable, an opportunity to export your data before it is deleted.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration and Security

To use the Service, you must create an account by verifying your phone number via SMS. You agree to:

  • Provide accurate and current information during registration
  • Maintain the security of your account and device
  • Notify us immediately of any unauthorized access to or use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

5. Call Recording Legal Compliance

IMPORTANT: You are solely and entirely responsible for complying with all applicable federal, state, local, and international laws regarding the recording of telephone conversations.

Recording laws vary significantly by jurisdiction:

  • Some jurisdictions require only one-party consent — meaning you may record a conversation you are a party to without informing the other parties
  • Other jurisdictions require all-party consent (also called "two-party consent") — meaning all parties to the conversation must be informed of and consent to the recording before it begins
  • Some jurisdictions have additional requirements, such as periodic notification tones or specific consent language
  • International calls may be subject to the laws of multiple jurisdictions simultaneously

Before recording any conversation, you must:

  • Determine which laws apply to your specific situation based on your location, the location of the other party or parties, and any other relevant jurisdictional factors
  • Obtain any and all consents required by applicable law from all parties to the conversation
  • Inform all parties of the recording where required by law
  • Ensure that your use of recordings complies with all applicable laws and regulations

Media Dot Ltd. assumes no responsibility or liability for your failure to comply with applicable recording laws. You agree to indemnify and hold Media Dot Ltd. harmless from any claims, damages, or losses arising from your recording activities.

6. Recording Notification Disclaimer

The Service may include audible beeps, tones, or other auditory notifications during recorded calls. Media Dot Ltd. makes NO WARRANTIES, representations, or guarantees that these notifications constitute adequate legal notice of recording under any jurisdiction's laws.

The presence of such notifications does not relieve you of your obligation to independently comply with all applicable recording consent and notification requirements. You must not rely solely on any automated notification feature to satisfy your legal obligations.

7. Acceptable Use

You agree not to use the Service for any unlawful or prohibited purpose. The following activities are expressly prohibited:

  • Recording conversations without obtaining any legally required consent
  • Using recordings for any illegal, fraudulent, or unauthorized purpose
  • Harassment, stalking, intimidation, or threatening behavior using recordings or the Service
  • Commercial resale, redistribution, or sublicensing of recordings or the Service without our express written permission
  • Interfering with, disrupting, or attempting to gain unauthorized access to the Service, its servers, or related infrastructure
  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App or Service
  • Using the Service to violate the privacy rights of any individual
  • Uploading or transmitting malicious code, viruses, or other harmful content through the Service
  • Using automated means (bots, scrapers, etc.) to access or interact with the Service

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including suspension or termination of the violator's account and reporting to law enforcement.

8. Subscriptions and Payments

Certain features of the Service require a paid subscription. By purchasing a subscription, you agree to the following:

  • Billing — subscriptions are billed through the Apple App Store via your Apple ID. All payments are processed by Apple and managed by RevenueCat. Media Dot Ltd. does not directly process your payment information.
  • Included usage — subscription plans include a set allowance of recording and transcription minutes per billing period, as shown at the point of purchase. If you use up your included minutes, some features (including starting new recordings and AI processing) may be unavailable until your next billing period begins.
  • Auto-renewal — subscriptions automatically renew at the then-current price unless you cancel before the end of the current billing period. You will be charged for renewal within 24 hours prior to the end of the current period.
  • Cancellation — you may cancel your subscription at any time through your device's Settings > [Your Name] > Subscriptions. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.
  • Uninstalling does not cancel — removing the App from your device does not cancel your subscription. You must cancel through your device's Subscription settings.
  • Refunds — refunds are handled by Apple in accordance with their App Store policies. Media Dot Ltd. does not issue refunds directly. To request a refund, contact Apple Support or visit reportaproblem.apple.com.
  • Price changes — subscription prices may change. If you do not agree to a price change, you may cancel your subscription before it renews at the new price.

9. AI-Processed Content Disclaimer

The Service uses third-party artificial intelligence services to generate transcriptions, summaries, entity extraction, commitment detection, topic identification, sentiment analysis, and other enriched content from your recordings.

AI-generated content may contain errors, inaccuracies, omissions, or misinterpretations. Specifically:

  • Transcriptions may not accurately reflect the spoken words, especially in cases of poor audio quality, accents, technical terminology, or overlapping speech
  • Summaries may omit important details or misrepresent the content of a conversation
  • Entity extraction may incorrectly identify or fail to identify names, organizations, or other entities
  • Sentiment analysis is inherently subjective and may not reflect the actual tone or intent of speakers

AI-generated content is provided "as is" for your convenience only. You are responsible for verifying the accuracy of any AI-generated content before relying on it. AI-generated content is not a substitute for professional, legal, medical, financial, or other expert advice. Media Dot Ltd. disclaims all liability for decisions or actions taken based on AI-generated content.

10. Intellectual Property

The Service, including the App, its design, code, features, logos, trademarks, and all related intellectual property, is owned by Media Dot Ltd. and is protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our express written permission.

All third-party trademarks, service marks, and logos appearing in connection with the Service are the property of their respective owners.

11. User Content and Data Ownership

You retain full ownership of your recordings, voice memos, and any content you create using the Service ("User Content").

By using the Service, you grant Media Dot Ltd. a limited, non-exclusive, worldwide, royalty-free license to process, store, transmit, and display your User Content solely for the purpose of providing and operating the Service. This includes sending your audio to Deepgram for transcription, sending transcript text to Anthropic and OpenAI for AI processing, and storing your content on Azure infrastructure.

This license terminates when you delete the applicable User Content or your account. Upon deletion, we will remove your User Content from our systems, subject to any legal obligations that may require temporary retention.

12. Data Retention and Deletion

Your recordings and associated data (transcripts, summaries, entities, etc.) are stored until you choose to delete them. You may delete individual recordings at any time through the App.

When you delete your account, all of your data is permanently and irreversibly deleted, including all recordings, transcripts, AI-generated content, and account information. We cannot recover deleted recordings or data.

13. Third-Party Services

The Service relies on third-party service providers, including but not limited to Twilio (telephony and SMS), Deepgram (transcription), Anthropic (AI enrichment), OpenAI (embeddings), RevenueCat (subscriptions), Microsoft Azure (cloud infrastructure), SendGrid (email delivery), PostHog (product analytics), and Sentry (crash reporting).

Media Dot Ltd. is not responsible for the availability, reliability, or performance of any third-party service. Service interruptions, delays, or failures caused by third-party providers are beyond our control. We make reasonable efforts to select reliable providers but cannot guarantee uninterrupted service.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Media Dot Ltd. does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any recordings will be successfully captured, processed, stored, or retrieved
  • Defects in the Service will be corrected
  • The Service or the servers that make it available are free of viruses or other harmful components

You use the Service at your own risk. You are solely responsible for any damage to your device or loss of data that results from your use of the Service.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Media Dot Ltd., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of recordings, data, or content
  • Loss of profits, revenue, or business opportunities
  • Loss of use or functionality
  • Cost of procuring substitute services
  • Any damages arising from unauthorized access to or alteration of your data

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF Media Dot Ltd. TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE ACTUALLY PAID TO Media Dot Ltd. FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Media Dot Ltd., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service, including any recordings you create
  • Your violation of these Terms
  • Your violation of any applicable law, rule, or regulation, including recording consent laws
  • Your failure to obtain any required consent from parties to recorded conversations
  • Any claim by a third party that their rights were violated by your use of the Service

17. Dispute Resolution

If you have a dispute with Media Dot Ltd. relating to the Service, you agree to first attempt to resolve the dispute informally by contacting us at privacy@callcapture.me. We will attempt to resolve the dispute through good-faith negotiation within thirty (30) days of receiving your notice.

If the dispute cannot be resolved informally, either party may pursue resolution through the courts as specified in the Governing Law section below.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts of Tel Aviv-Jaffa, Israel, and you consent to the jurisdiction of those courts.

Nothing in these Terms shall deprive you of any mandatory consumer protection rights, or of the protection of any provisions that cannot be waived by agreement, under the laws of your country or state of residence.

19. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or any applicable law
  • Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the Service
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies

You may terminate your account at any time by deleting your account in the App (Settings > Delete Account). Upon termination:

  • Your right to access and use the Service immediately ceases
  • All data associated with your account will be permanently deleted
  • Any active subscription will continue until the end of the current billing period (cancellation of the subscription must be done separately through your device's Settings)

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

20. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by other appropriate means. Material changes will be effective upon the date indicated in the updated Terms.

Your continued use of the Service after the effective date of any modified Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

21. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Media Dot Ltd. regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
